2025 Terms & Conditions

Effective date: October 22, 2025

These Terms of Service (“Terms”) govern your use of websites, ticketing, donations, email subscriptions, and other services provided by Magnolia Arts Center (“MAC,” “we,” “us,” or “our”). By accessing or using our services, you agree to these Terms and our Privacy Policy.

If you do not agree, do not use the Services.

Eligibility & accounts

You must be at least 13 to use our online Services and 18 to make purchases or donations. If you create an account (e.g., for ticketing), you’re responsible for keeping your login secure and for all activity under your account. Tell us promptly about any unauthorized use.

Ticketing, seating & admission

  • Purchases: Ticketing is processed by third-party providers (e.g., Arts People/Neon One). Service/processing fees may apply.

  • Delivery: Digital or will-call delivery options vary by event. Bring a valid ID for will-call.

  • Late seating: Late arrivals may be seated at staff discretion at an appropriate break; specific seats are not guaranteed after the curtain.

  • Policies: Outside food/beverage, photography, and recording rules vary by venue and production; follow posted and staff instructions. We may refuse or revoke admission for safety or policy violations.

All sales final; exchanges & cancellations

  • Refunds: Unless stated otherwise for a specific event, all ticket sales are final and non-refundable, including service fees.

  • Exchanges: When available, exchanges may be offered for another performance/date of the same production, subject to availability and any exchange fees or price differences.

  • Canceled or rescheduled events: If an event is canceled and not rescheduled, we will provide options consistent with our policy and applicable law (e.g., refund of face value, exchange, or donation credit). If rescheduled, your original tickets are typically valid for the new date.

  • Force majeure: We aren’t liable for delays or failures caused by events beyond our reasonable control (e.g., severe weather, public health orders, power outages).

Donations & recurring gifts

Online donations are processed by third-party providers. We do not store complete payment card numbers on our systems.

  • Receipts: We issue receipts for tax purposes as allowed by law.

  • Mistaken donations: If you believe a donation was made in error, contact us at info@magnoliaartscenter.com within a reasonable time, and we’ll review the request.

Pricing, fees & taxes

Prices, fees, discounts, and availability can change without notice. Advertised prices generally exclude service, facility, and processing fees. Sales and use taxes may apply.

Programs & content may change

Program titles, casting, run times, and artists are subject to change. Promotional materials are for general information only.

Acceptable use

You agree not to: (a) interfere with the operation or security of the Services; (b) use the Services for unlawful, infringing, or fraudulent purposes; (c) scrape or harvest personal information; (d) attempt to circumvent access controls; or (e) upload content that is illegal, harassing, defamatory, obscene, or otherwise objectionable.

Your submissions & feedback

If you submit comments, reviews, or other content (“User Content”), you grant MAC a non-exclusive, worldwide, royalty-free license to use, display, reproduce, distribute, and adapt that content for our nonprofit mission and marketing, in any media, with or without attribution, consistent with applicable law. You represent that you have the rights to grant this license and that your User Content complies with these Terms.

Intellectual property

Site content, logos, and materials are owned by MAC or our licensors and are protected by law. Except as permitted by fair use or written permission, you may not reproduce, distribute, modify, or create derivative works from our content.

Third-party services

We use third-party platforms (e.g., Arts People/Neon One, payment processors, email services). Your use of those features may be subject to the third parties’ terms and privacy policies. We are not responsible for third-party websites or services.

Accessibility & accommodations

MAC strives to make performances accessible. For accommodation requests (e.g., seating, assistive listening), contact info@magnoliaartscenter.com or 888-622-3868 in advance of your visit. Availability may vary by venue and performance.

Photography & recordings at events

By attending MAC events, you understand that audiences may be photographed, filmed, or recorded. Your presence constitutes permission for MAC to use your image/voice for noncommercial archival and promotional purposes in furtherance of our mission, as allowed by law. If you have concerns, speak with a staff member before the performance.

Disclaimers

THE SERVICES AND EVENT INFORMATION ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted or error-free.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MAC AND ITS OFFICERS, EMPLOYEES, AND VOLUNTEERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. MAC’S TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO MAC FOR THE TRANSACTION GIVING RISE TO THE CLAIM (IF ANY).

Some jurisdictions do not allow certain limitations; in such cases, the above limitations apply to the maximum extent permitted.

Indemnification

You agree to indemnify and hold harmless MAC, its officers, employees, and volunteers from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Services.

Governing law & venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Pitt County, North Carolina for any dispute arising from these Terms or the Services, except where prohibited by law.

Changes to these Terms

We may update these Terms from time to time. The “Effective date” above reflects the latest revision. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

General

  • No waiver: A failure to enforce a provision is not a waiver.

  • Severability: If any provision is found unenforceable, the remainder remains in effect.

  • Entire agreement: These Terms, together with our Privacy Policy and any event-specific terms, are the entire agreement between you and MAC regarding the Services.
